This document (“the Agreement”) sets forth the complete terms and conditions that apply to the Bargain Car Rentals Affiliate Agreement. As used in this Agreement, “Bargain Car Rentals Australia” means the trading name of Bargain Car Rentals Australia Pty Ltd (ABN 34 115 153 930) and “you” means the affiliate.
1. Affiliate Eligibility and Approval
Bargain Car Rentals’ affiliate program approves quality businesses in the car rental and travel/tourism industries. Applications from other industries may be considered at the discretion of Bargain Car Rentals. Upon approval, an email confirmation containing your unique Affiliate Code, imagery, and relevant links will be sent within seven business days. Bargain Car Rentals reserves the right to reject applications with potentially offensive or inappropriate content, including but not limited to:
- Sexually explicit or adult-oriented materials
- Violence promotion
- Animal cruelty or abuse
- Discrimination based on race, sex, religion, nationality, disability, sexual orientation, or age
- Illegal services or materials, including email or internet spamming and hacker practices
2. Affiliate Responsibilities
As an affiliate of Bargain Car Rentals, you agree to actively promote Bargain Car Rentals through banner ads, text, booking forms, and other promotional materials on your website. You are responsible for your site’s development, operation, and maintenance, as well as ensuring the content does not infringe on any third-party rights. Bargain Car Rentals disclaims liability for these matters, and you agree to indemnify and hold harmless Bargain Car Rentals and its affiliates from any damages, claims, or expenses.
3. Bargain Car Rentals’ Obligations
Bargain Car Rentals will handle customer inquiries and services, including rental reservations. Customers using your affiliate code will receive a 5% discount. We will track sales from your code, and you will earn a 5% commission (including GST for Australian businesses) on eligible* rentals. No credit will be given for cancelled or incomplete reservations. Commissions will be paid monthly within 28 days of the month’s end, accompanied by a recipient-created report.
*Eligible rentals include rentals that have been paid for in full, returned, and closed.
You will be required to invoice Bargain Car Rentals for the commission amount owed to you. Whether this is an invoice that is GST inclusive of GST exclusive is determined by your own GST status. This will need to be sent to accounts@bargaincarrentals.com.au
4. Term of the Agreement
The agreement begins on a mutually agreed-upon date and may be terminated by either party with at least 30 days written notice (email acceptable). No commissions will be paid for customers who rent cars after termination, but commissions on reservations made before termination will still be paid upon the closing of those reservations.
5. Relationship of Parties
You and Bargain Car Rentals are independent contractors, and nothing in this Agreement shall be deemed to create any partnership, joint venture, agency, franchise, sales representative, or employment relationship between us. You do not have the right to accept any offers on behalf of Bargain Car Rentals or to act for or bind Bargain Car Rentals in any manner and you shall not make any statement, whether or not on your site, to indicate otherwise.
6. Limitation of Liability
Bargain Car Rentals will not be liable for any indirect, special, or consequential damages arising in connection with this agreement or any items sold under it.
7. Disclaimers
Except as required by law, Bargain Car Rentals makes no express or implied warranties or representations regarding any items sold under this agreement or the operation of our site.
8. Intellectual Property
You acknowledge that the Bargain Car Rentals site contains copyrighted and trademarked information, data, graphics, and other materials protected by law. These rights are valid and protected in all existing and future forms, media, and technologies.
9. Modification of Terms
Bargain Car Rentals may change, modify, or add terms and conditions to this agreement at any time. Changes will be effective immediately upon notice, which may be provided via the site. Your continued participation constitutes acceptance of these changes.
